El presente artículo tiene como objeto llevar a cabo un estudio pragmático y analítico sobre la acción de valoración, el valor y los valores a la luz de la ciencia semiótica y de la ciencia cibernética. Por ello, se desarrollará un proceso axiológico que ilustre cómo sucede el ingreso, la transición y la salida de códigos morales en función de un esquema cognitivo. Así pues, el proceso axiológico se postula, primero, en fundamento de tres sistemas: de mentalidad, de valores y (...) de biomoralidad y, segundo, conforme a la teoría de la información y de la teoría general de sistemas. It is often suggested that when opinions differ among individuals in a group, the opinions should be aggregated to form a compromise. This paper compares two approaches to aggregating opinions, linear pooling and what I call opinion agglomeration. In evaluating both strategies, I propose a pragmatic criterion, No Regrets, entailing that an aggregation strategy should prevent groups from buying and selling bets on events at prices regretted by their members. I show that only opinion agglomeration is able to satisfy the (...) demand. I then proceed to give normative and empirical arguments in support of the pragmatic criterion for opinion aggregation, and that ultimately favor opinion agglomeration. (shrink)

El propósito central del presente artículo, es formular un enfoque sistémico-jurídico para el análisis de los sistemas sociales. Para esto, se proponen tres tipologías de consensos denominados límites del sistema social: consenso normal, consenso normativo y consenso legítimo. La función de estas tipologías es, primero elaborar una explicación sobre la constitucionalización y democratización del poder político, con base en la regla de reconocimiento y la norma fundamental de un Estado; segundo postular dos metodologías normativas, un registro positivo y una demarcación (...) positiva, que desplieguen, tanto sobre las conductas sociales como sobre la estructura del sistema social, un proceso de legalidad emergente, cuya función sea, tercero regular, realimentar y optimizar el funcionamiento de la constitución política. Finalmente, se analizan los conceptos de completitud y de legitimidad del sistema normativo, con el fin de definir el alcance institucional que debe poseer un sistema jurídico sobre los subsistemas culturales del sistema social. Si concebimos el bienestar como condición para que se dé auténtica dignidad en la vida individual y/o colectiva, entre diferentes especies y generaciones de especies, lo cierto es que cabría colegir que la dignidad no tiene una única naturaleza ni, en relación a la que cupiera definir como la más conveniente o necesaria o justa, se instituye conforme a idénticos grados. La (esencia de la) dignidad sería, por consiguiente, relativa. Analicemos esto.

PURPOSE—A substantial fraction of the observations made by clinicians and entered into patient records are expressed by means of negation or by using terms which contain negative qualifiers (as in “absence of pulse” or “surgical procedure not performed”). This seems at first sight to present problems for ontologies, terminologies and data repositories that adhere to a realist view and thus reject any reference to putative non-existing entities. Basic Formal Ontology (BFO) and Referent Tracking (RT) are examples of such paradigms. The (...) purpose of the research here described was to test a proposal to capture negative findings in electronic health record systems based on BFO and RT. METHODS—We analysed a series of negative findings encountered in 748 sentences taken from 41 patient charts. We classified the phenomena described in terms of the various top-level categories and relations defined in BFO, taking into account the role of negation in the corresponding descriptions. We also studied terms from SNOMED-CT containing one or other form of negation. We then explored ways to represent the described phenomena by means of the types of representational units available to realist ontologies such as BFO. RESULTS—We introduced a new family of ‘lacks’ relations into the OBO Relation Ontology. The relation lacks_part, for example, defined in terms of the positive relation part_of, holds between a particular p and a universal U when p has no instance of U as part. Since p and U both exist, assertions involving ‘lacks_part’ and its cognates meet the requirements of positivity. CONCLUSION—By expanding the OBO Relation Ontology, we were able to accommodate nearly all occurrences of negative findings in the sample studied. (shrink)

La biología utiliza múltiples criterios para individuar fenómenos biológicos. Frente a esta diversidad, los enfoques monistas proponen criterios fundamentales para el reconocimiento unívoco de individuos, esto es, formas únicas de dividir el mundo biológico en entidades individuales. El pluralismo, por otro lado, argumenta que no deberíamos restringir el estudio de la individualidad a concepciones únicas, reconociendo, en su lugar, diferentes tipos de individuos. En este artículo, analizaré cómo ciertos enfoques monistas y pluralistas enfrentan la pluralidad de criterios de individuación utilizados (...) por la práctica científica. Siguiendo las recientes aproximaciones epistemológicas y pragmáticas en filosofía de la individualidad biológica, argumentaré por qué la diversidad de individuaciones no suele representar un inconveniente para la biología y por qué contribuye a nuestro conocimiento del mundo biológico. La conclusión general será que requerimos múltiples maneras de individuar la naturaleza para poder cumplir los diversos objetivos epistémicos de la biología, una labor que las aproximaciones monistas no suelen visibilizar. We may succed in the fulfilment of our desires but still fail to properly own our practical life, perhaps because we acted as addicts, driven by desires that are alien to our will, or as “wantons,” satisfying the desires that we simply happen to have (Frankfurt, 1988 ). May we equally fail to own the outcomes of our epistemic life? If so, how may we attain epistemic ownership over it? This paper explores the structural parallellism between practical and epistemic rationality, (...) building on Williamson’s ( 2002 ) suggestion that we should commence with successful performances as the foundation for both domains, be it action or knowledge. By highlighting the limitations of higher-order regulative approaches in epistemology, exemplified by Sosa ( 2007, 2011, 2015, 2021 ), the paper introduces a form of teleological epistemic constitutivism inspired by Velleman ( 2000, 2009 ). The proposal is that epistemic ownership is not attained in the mere pursuit of truth or knowledge, but requires furthermore a struggle to understand what we know. (shrink)

Speech Acts, Criteria and Intentions What makes a speech act a speech act? Which are its necessary and sufficient conditions? I claim in this paper that we cannot find an answer to those questions in Austin's doctrine of the infelicities, since some infelicities take place in fully committing speech acts, whereas others prevent the utterance from being considered as a speech act at all. With this qualification in mind, I argue against the idea that intentions—considered as mental states accomplishing a (...) causal role in the performance of the act—should be considered among the necessary conditions of speech acts. I would thus like to deny a merely ‘symptomatic’ account of intentions, according to which we could never make anything but fallible hypotheses about the effective occurrence of any speech act. I propose an alternative ‘criterial’ account of the role of intentions in speech acts theory, and analyse Austin's and Searle's approaches in the light of this Wittgensteinian concept. Whether we consider, with Austin, that speech acts ‘imply’ mental states or, with Searle, that they ‘express’ them, we could only make sense of this idea if we considered utterances as criteria for intentions, and not as alleged behavioural effects of hidden mental causes. Take the strong rhetoric! This expression comes to mind as we set in order the ideas and impressions prompted by Sandra Harding’s “An Organic Logic of Research: A Response to Posey and Navarro”.

Reductive intellectualists (e.g., Stanley & Williamson 2001; Stanley 2011a; 2011b; Brogaard 2008; 2009; 2011) hold that knowledge-how is a kind of knowledge-that. If this thesis is correct, then we should expect the defeasibility conditions for knowledge-how and knowledge-that to be uniform—viz., that the mechanisms of epistemic defeat which undermine propositional knowledge will be equally capable of imperilling knowledge-how. The goal of this paper is twofold: first, against intellectualism, we will show that knowledge-how is in fact resilient to being undermined by (...) the very kinds of traditional (propositional) epistemic defeaters which clearly defeat the items of propositional knowledge which intellectualists identify with knowledge-how. Second, we aim to fill an important lacuna in the contemporary debate, which is to develop an alternative way in which epistemic defeat for knowledge-how could be modelled within an anti-intellectualist framework. One of the challenges related to the discursive practices of argumentative agents is to get to know if those interactions have an institutional effect. In this article, it is argued that in the new institutionalism, theoretical approaches and deterministic analysis are outlined to investigate argumentative practices that take place in processes of legitimation and recognition. Here a double socio-institutional and discursive or constructivist approach to the argumentation theory is defended, and it is argued that this perspective could be extended to (...) a research program aimed at interpreting argumentative processes in the public sphere that act as calculation mechanism and conformation of social capital. The central point is that the consciousness is an advanced information channel. Consciousness is not the seat of the self or free will. The action is in the sub-consciousness brain systems. Consciousness is a "just so story teller" consciousness collects and correlates scenes into sequential presentations. The function of consciousness is to provide a new information channel between other brain systems. The pre-consciousness communication between brain systems evolved and is limited by the possible pathways, these pathways did not provide the (...) possibility of a historical correlation or integration with a high level pattern of cause and effect at a significantly abstract but focused level. Consciousness provides this pathway. Consciousness provides this pathway by providing a method for the brain to take its existing expressions both visual and auditory and re-create a time line of experiences and conversations that are then re-presented to the rest of the brain through the existing sensory channels at the level of the brain. This is not a feedback loop in the simple sense, but a feedback loop of a rarified and extremely intensely processed, correlated and organized remembering. This allows the brains different functional entities to get information that it could not get from the evolved pre-consciousness internal pathways. These presentation are used by the other brain systems in a manner similar to any sensory input. This perspective would place Consciousness in the position of a cyber reality generator that feeds back to the rest of the brain. (shrink)

Our attempts at simulating the mind’s skills is based on our own just-so-stories -/- Our attempts at simulating the human mind’s skills are based on our own just-so-stories. These are creative narratives that are produced by our imaginative mind. The brain does not and cannot tell us how it works; it can only produce a belief, a narrative, or a just-so-story.

Knowledge, like other things of value, can be faked. According to Hawley (2011), know-how is harder to fake than knowledge-that, given that merely apparent propositional knowledge is in general more resilient to our attempts at successful detection than are corresponding attempts to fake know-how. While Hawley’s reasoning for a kind of detection resilience asymmetry between know-how and know-that looks initially plausible, it should ultimately be resisted. In showing why, we outline different ways in which know-how can be faked even when (...) a given performance is successful; and in doing so, we distinguish how know-how can be faked (no less than know-that) via upstream and downstream indicators of its presence, and within each of these categories, we’ll distinguish (in connection with detection resilience) both faking symptoms and (various kinds of) criteria. The unappreciated resilience of faked knowledge-how to successful detection highlights a largely overlooked dimension of social-epistemic risk – risk we face not just in our capacity as recipients of testimony, but in our capacity as both (would-be) apprentices and clients of knowledge-how. The relationship between the necessity to ensure that information is shared in the stages of deliberation and the overcoming of what Dryzek (2001) called constriction of deliberative economy is directly related to the proponents and opponents’ propensity to submit and add information differently, in a plural manner. This article describes the salient features of the deliberative turn in order to defend that this propensity is not individual. The evolution of the public space in science and in politics are both paradigmatic (...) examples to appreciate that individual deliberation, and even mere aggregation of opinions, are consistently interpreted only if they are part of social practices and collective institutions aimed at defending tolerance towards positions, beliefs and interpretations that are different or even confronted. This paper argues that the so called model of contestatory deliberative democracy contributes to the acquisition of knowledge precisely because it fosters a plurality of epistemic states associated with practices as consensus and dissent. This article presents an explanatory hypothesis regarding an anomalous fact: the omission of complete information but also of the necessary interpretation about the identity traits and specific characteristics of civil society observed in many theoretical and practical contributions in studies on deliberative democracy. The difference between liberal democracy and the deliberative model is blurred when the task of interpreting deliberative practices is relegated or when the approach of critical theory is not applied in the analysis of the material political culture (...) of which deliberative agents are both the architects and the recipients. The hypothesis presented emphasizes the difficulties and systematic rejection generated by the main emancipatory achievements of modern citizens. The resistance aroused by these achievements among prestigious interlocutors of civil society has fueled a sophisticated reactionary rhetoric, which was reported by social science researcher Albert O. Hirschman. At the same time, the explanatory hypothesis used here has a key assumption: the existence of a striking correlation between certain argumentative imperatives and the meager cultural attention that the valuable pluralism observable in deliberative behavior receives today. En estas páginas hemos presentado varios argumentos para defender que existe una conexión entre el empleo de heurísticas y los procesos de deliberación. En lugar de caracterizar las heurísticas en función de las disciplinas, los campos y/o los ámbitos en que se emplean—tal y como hace, por ejemplo, el grupo ABC, i.e. racionalidad ecológica—las hemos proyectado sobre nuestros enclaves deliberativos, esto es, sobre un espacio eminentemente retórico y político. En dichos enclaves, tal y como solía recordarnos Quintín Racionero, la téchne (...) de la persuasión se nos presenta como parte del órganon de la filosofía práctica porque está aplicada a un espacio ontológico fundado por la comunicación humana. Y es en el seno de dicha comunicación como cabe entender la proliferación de razonamientos heurísticos encaminados al cálculo, la estimación y/o la ponderación, con ayuda de los cuales no sólo se orienta la acción colectiva sino las mismas fases de la deliberación. Las definiciones de argumentación son tan variadas como las distintas posiciones existentes en torno a la pregunta de qué hacemos exactamente cuando argumentamos y cuándo estamos, de hecho, argumentando. Incluso el mismo autor puede ofrecer más de una definición de lo que entiende por argumentación; en parte, porque el problema de la argumentación no se circunscribe a un solo ámbito, ni del conocimiento ni de la vida práctica.

El estudio y análisis de las argumentaciones cotidianas entendidas como interacciones discursivas e intencionales encaminadas a dar cuenta de algo con el fin de lograr que aquello que se sostiene sea aceptado, sería inconcebible sin la aparición de la teoría de los actos de habla de Austin (1962), la propuesta de Searle (1969), el trabajo de Grice sobre la teoría de la conversación (1975) y el importante estudio sistemático de Hamblin sobre el argumento falaz (1970). Como una reelaboración de dichas (...) obras cabe entender la teoría pragmadialéctica de la argumentación propuesta inicialmente por Frans H. van Eemeren y Rob Grootendorst (1984). Algunos autores (Blair, 2006: 11; Woods, 1992) creen ver en ella, más que una teoría, una amalgama de varias teorías y una particular versión de la teoría pragmadialéctica de la argumentación, entendiendo ésta bajo una acepción más general. Otros consideran que ni es útil ni tampoco especulativamente productivo sostener que de toda argumentación pueda buscarse un modelo según el cual ésta buscaría resolver una diferencia de opinión (Goodwin, 1999). Este artículo muestra la conexión entre heurísticas sociales y deliberación. En lugar de caracterizar las heurísticas según disciplinas o campos, aquí se proyectan sobre nuestros enclaves deliberativos. La autora sostiene que el empleo de heurísticas sociales orienta el flujo de la información y la participación en las distintas fases deliberativas, y es necesario analizarlas para establecer indicadores con los que medir grados de deliberación. Esta hipótesis da lugar a una visión pluralista sobre la función social de las heurísticas entendidas como (...) caja de herramientas con nuevos instrumentos y utilidades sociales. Según dicha perspectiva, habría que integrar este tipo de razonamiento en un plan de acción más amplio que explicara en qué sentido las heurísticas son recursos que producen conocimiento, al tiempo que un tipo de conocimiento ya producido. La oposición a una estricta separación entre las dimensiones dialéctica y retórica de la actividad argumentativa es una de las aportaciones más destacadas y peculiares de la denominada escuela holandesa sobre argumentación. Frans H. van Eemeren y Peter Houtlosser reaccionaron contra una separación estricta entre dialéctica y retórica en varios trabajos, pero uno de los más inspiradores es sin duda su artículo “William the Silent’s argumentative discourse” (1998) presentado en la ciudad de Ámsterdam con ocasión de la cuarta conferencia organizada (...) por la International Society for the Study of Argumentation (ISSA). Sobre este tema siguieron investigando para presentar un análisis de la perspectiva dialéctica inherente al caso de Guillermo I de Orange en un congreso de la Japan Debate Association en Tokio (van Eemeren y Houtlosser, 2000). This opinion is not just frequent but also quite reasonable. In fact, during the 1990s, there was a certain controversy concerning this topic that confronted two of the leading groups in the field of heuristic reasoning research, each of whom held very different perspectives. In 1685, in The Art of Discovery, Leibniz set down an extraordinary idea: "The only way to rectify our reasonings is to make them as tangible as those of the Mathematicians, so that we can find our error at a glance, and when there are disputes among persons, we can simply say: Let us calculate [calculemus], without further ado, to see who is right." Calculemus.

Concepts as reasonable doubt, cognitive biases and emotions are now a theoretical problem for the practice of law, and the law understood as legal argumentation. From a theoretical point of view, the screenplay written by Reginald Rose, Twelve Angry Men, is an outstanding example to analyze some of these concepts, and its influence on procedural stage. Cognitive biases and informal fallacies are theoretical challenge to legal argumentation.

The paradigm of referent tracking is based on a realist presupposition which rejects so-called negative entities (congenital absent nipple, and the like) as spurious. How, then, can a referent tracking-based Electronic Health Record deal with what are standardly called ‘negative findings’? To answer this question we carried out an analysis of some 748 sentences drawn from patient charts and containing some form of negation. Our analysis shows that to deal with these sentences we need to introduce a new ontological relationship (...) between a particular and a universal, which holds when no instance of the universal has a specific qualified ontological relation with the particular. This relation is found to be able to accommodate nearly all occurrences of negative findings in the examined sample, in ways which involve no reference to negative entities. (shrink)

Der Begriff der Toleranz in der Moderne wurde erdacht mit dem Ziel, Gesellschaften zu organisieren, die sich im Umbruch befanden auf Grund des plötzlichen Eindringens von Glaubensunterschieden in die politische Raumordnung. Die Definition der Toleranz als Tugend, die auf der Nachgiebigkeit gegenüber dem Andersartigen basiert, ist ein Pseudobegriff. Die hermeneutische Veranlagung, die mit der Philosophie einhergeht, zeigt, dass die Toleranz keine schlichte moralische Tugend sein kann, sondern vielmehr eine der Beschaffenheiten der Möglichkeit rationaler Handlungen (die Arten des Seins und des (...) Sagens fallen in der Vielfältigkeit ihrer Formen zusammen). Die Geschichte der Hermeneutik zeigt seit ihren Anfängen – die exegetische Arbeit war hierbei grundlegend – die Zwickmühlen der Existenzformen der Rationalität und lässt nur ein Denken an der Grenze zu, welche ihre Grundlage ist: Es gibt keine Tatsachen, sondern Interpretationen. In the last forty years the number of specialized publications on deliberative democracy has increased steadily. Yet, today, one of the greatest challenges we still face today is to deepen into the knowledge of our actual and singular deliberative cultures. In order to achieve this, it is necessary that we use theoretical and methodological approaches that enable us to capture the inherent complexity to the specific forms of deliberation that are present in as different areas as that of politics, economics, (...) law, science, urbanism or the Net. En este artículo se analiza el planteamiento de Reinhart Koselleck en torno a la Begriffsgeschichte desde el punto de vista de la productividad de la historia, el tiempo y la productividad propia de la dialéctica de los conceptos. Para ello se traen a colación aspectos muy precisos de la filosofía de Aristóteles, Hegel y Gadamer. La reflexión concluye extrayendo algunas aportaciones que podrían enriquecer la investigación de Koselleck.

The objective of this paper is to analyse, from a philosophical perspective, the 16th and 17th Century models of currency, as well as their influence on the types of society in which the models developed. For this, the author values the study by the French philosopher Michael Foucault Words and Things on this matter and the principal foundations of Ludwig von Bertalanffy´s systems theory. The 17th Century model of currency is based on the notion of a system of exchange. The (...) notion of a system of exchange represents a transformation of great significance, upon which the principal characteristics of our current globalised era are founded, not only in economic life, but also in relation to an understanding of the world that it implies. Furthermore, the notion of a system of exchange was the step before the current model of electronic payments of the digital era, in which large transactions (and also large data transfers) take place by pressing a button. The principal idea of the paper is that these economic practices hold the key to deepen a philosophical and historical comprehension of concepts such as globalisation. (shrink)

In this paper art history and visual studies, the disciplines that study visual culture, are presented as a field whose conjectural paradigm can be used to understand the epistemic problems associated with abduction. In order to do so, significant statements, concepts and arguments from the work of several specialists in this field have been highlighted. Their analysis shows the fruitfulness and potential for understanding the study of visual culture as a field that is interwoven with the assumptions of abductive cognition.

«Fortaleza» y «debilidad» son dos adjetivos que se han utilizado prolijamente en la literatura científica sobre institucionalismo para describir la permanencia o, por el contrario, la porosidad y maleabilidad de las reglas y principios rectores en los que están atrincheradas las instituciones que sobreviven en equilibrio y, por tanto, no son alteradas unilateralmente.

Benito Pérez Galdós encontró en la clase media una fuente de inspiración para la creación de una novela de costumbres con una destacada dimensión política: describir y hacer comprensibles los problemas de índole moral que hacían muy difícil concebir e implantar un orden social basado en la prosperidad individual y colectiva. Aunque su talante descriptivo, su técnica realista, costumbrista e incluso naturalista, como se ha dicho en alguna ocasión —sin que estemos aquí completamente de acuerdo con ello—,es una de las (...) más sobresalientes de las letras españolas, Galdós nunca renunció al uso de una poderosa voz narrativa con la que imprimió a su literatura un declarado afán de comprensión de la realidad social.
